Intelligent Speed Adaptation
Terms and Conditions of Use of ISA Advisory Map
The downloading and use of Transport for London's (TfL's) Intelligent Speed Assistance (ISA) Advisory Map is governed by these Terms and Conditions. Additional terms and conditions apply to use generally of TfL's website at http://www.tfl.gov.uk.
TomTom® is a registered trade mark owned by TomTom International B.V. The ISA Advisory Map has been independently developed by TfL for download on to TomTom® satellite navigation systems. TomTom International B.V does not endorse the ISA Advisory Map and there exists no trading connection or relationship (economic or other) between TfL and TomTom B.V International.
The ISA Advisory Map has been developed and is provided by TfL for download onto TomTom® satellite navigation systems only. The ISA Advisory Map is not recommended for use in conjunction with any other satellite navigation and/or GPS systems and TfL shall not be responsible in any way for use in conjunction with the same.
The downloading of the ISA Advisory System from this website is done entirely at the individual or company downloading and/or using the ISA Advisory Map ("the User") own risk and the User, not TfL, will be entirely responsible for any resulting damage and/or resulting loss of data to its TomTom® (or other satellite navigation device) or other equipment, even if TfL has been advised of the possibility of such damage
The ISA Advisory Map must be downloaded directly from the TfL website by the User and must not be transferred from one TomTom® to another. No other use of the ISA Advisory Map may be made by the User, including but not limited to modifying, adapting, amending, publishing, broadcasting, posting and copying the same. Permission for any other type of use must be obtained - TfL Customer Services may be contacted for details.
The ISA Advisory System is provided "as is" without any representation, guarantee or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, compatibility, non-infringement, accuracy and security.
The ISA Advisory Map will be updated approximately every three months and Users are advised to download an updated version of the ISA Advisory Map at least every three months.
Whilst TfL will endeavour to ensure that the ISA Advisory Map is up to date, accurate and functioning properly, due to frequent and sudden changes in speed limits, this will not always be achievable and TfL does not guarantee or represent that the speed limits indicated by the ISA Advisory System will always be accurate, complete or current.
Wherever and whenever the ISA Advisory Map indicates to the User a speed limit which differs to that which is indicated by a road sign (fixed, electronic or otherwise), the speed limit indicated by the road sign must be followed at all times, without exception.
TfL shall not be responsible for any fines, costs and/or penalties of any kind whatsoever the User may incur as a result of its use of the ISA Advisory Map.
Use of the ISA Advisory System is entirely at the User's own risk. The User, and not TfL, will be entirely reponsible for any distraction the ISA Advisory Map may cause to the User. Users are responsible for the appropriate placing of the Tom-Tom® system in vehicles. TfL expressly excludes to the extent permissible in law all liability whatsoever for any injury, death, damage or direct, indirect or consequential loss howsoever caused from the use or inability to use ISA Advisory System, whether directly or indirectly resulting from inaccuracies, defects, viruses, errors, omissions, out of date information or otherwise.
The copyright and other intellectual property rights (such as, design rights, trademarks, patents etc.) in the ISA Advisory Map belong to TfL.
These terms and conditions will be governed and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over disputes between a user and TfL arising out of the access or use of these websites. Omission by TfL's to exercise any right under these terms and conditions will not constitute a waiver of such right unless expressly stated by TfL in writing.
