Ground three
No Penalty Charge is payable under the scheme (eg I was not in the charging area).
The Regulations define this ground as:
That no Penalty Charge is payable under the Low Emission Zone scheme.
There are a number of circumstances which may or may not be applicable, including:
- Exempt vehicles
The following vehicles will automatically be exempt from the Low Emission Zone (LEZ) if registered in Great Britain:
- Vehicles designed and built for mainly off-road use but which may be used on the road for limited purposes, including agricultural and forestry tractors, mowing machines, agricultural and farm machinery, and equipment, mobile cranes, and road and building machinery
- Historic vehicles (built before 1 January 1973)
- Military vehicles
- Discounts
Certain showman's vehicles are eligible for a 100 per cent discount. This will only apply to vehicles which have been custom built and are permanently fitted with equipment forming part of a show. Operators of such vehicles will need to register with TfL to qualify for the discount.
- Diversions
If you are diverted into the LEZ due to an incident, accident or roadworks, you should either follow the diversion route or leave as soon as possible. When making a Representation, please give as many details as possible, including the location and time of the diversion, as well as whether you spoke to a police officer. We will check our records to confirm if a diversion was in place. If, however, you entered the LEZ to avoid traffic, or because you got lost or swerved, these are not valid grounds for a Representation.
- Signs and boundary
The boundary to the LEZ is clearly marked with approved road signs. Reasons such as you not seeing the signs or there not being enough signs will not be accepted by TfL. However, if you believe your vehicle did not enter the LEZ or that the signs are incorrect, please provide full details with your Representation, including the exact location and route you took.
- Exiting the LEZ
Leaving the LEZ will not be accepted as a valid reason for not paying the charge as the it is payable if a vehicle travels within the LEZ during charging hours, whether entering, exiting or just moving within the zone.
